Trademark Law – The Charlie Sheen Trademark Gold Rush!

While attending the Downtown Los Angeles Art Walk last week, vendors were seen selling T-shirts with several of Charlie Sheen’s catch-phrases such as “Winning!”

Apparently numerous entrepreneurs with a dream are bombarding the US Patent and Trademark Office seeking to trademark another one of Sheen’s expressions, “Tiger Blood,” (referring to a favorite drink).  The Indiana IP & Technology Blog does a good job of listing all the recent trademark filings for Tiger Blood, including an application by Jimmy Buffett’s restaurant chain, Margaritaville, seeking to trademark Tiger Blood for a cocktail!

As a refresher on trademark law, a trademark is a distinctive word, phrase, logo, domain name, graphic symbol, or slogan that is used to identify the source of a product and to distinguish a manufacturer’s or merchant’s products from another.  Trademark disputes happen when multiple trademarks cause customers to become confused about the source of a product.  Time will tell how many of these Tiger Blood trademark applications are granted.
